I have been going through Heir & Devisee Commission Papers (Heir & Devisee Commission papers 1797-1854 digitized records to create a working corrected Finding Aid. You may view the corrected content lists at Heir & Devisee Commission

While scrolling through microfilm H 1140 in order to correct Canadiana.org's flawed content description, I came across a set of Land Certificates and other documents from individuals living in what was called the Home District. This consisted of land along Lake Ontario and the Niagara region of Ontario.

Home District Land Claims 1803 & 1804

Canadiana.Org has digitized 21 films of the Heir & Devisee Commission Papers (Heir & Devisee Commission papers 1797-1854, found in their Heritage Collection), and that's a good thing for genealogists. These records have valuable and informative genealogical documents.

But as mentioned in a previous blog post Heir & Devisee Commission 1797-1854 on Canadiana.org - Listing Errors and a Workaround, the index and description of what is in each film, as provided on Canadiana.org, is incorrect.

I have been going through those digitized records to create a working corrected Finding Aid. You may view the corrected content lists on Olive Tree Genealogy website at Heir & Devisee Commission

This consisted of land along Lake Ontario and the Niagara region of Ontario.

Continuing on from Home District Land Certificates 1787 to 1795 and An index to Niagara area Loyalists and their Land Certificates here is the start of my list of names of claimants for land in the Home District from 1803-1804. Each name has an image number beside it so that you can easily click through to that image to view the claims and any supporting documents.

Images 250–253 index to claimant names. These images have lists of names of claimants. Note that often it is the attorney's name on the index and not the petitioner or claimant. The claimants' names can be viewed in my list below. Please also note that I cannot guarantee my interpretation of the names in these documents. The writing is often difficult to read or the image is blurry.

It's Not Just Loyalists! (A Misleading Title on Ancestry)

Recently I poked around a database record set on Ancestry.com. The title is UK, American Loyalist Claims 1776-1835. In the description given by Ancestry we read that "Records in this database relate to Loyalist claims and cases heard by the American Loyalist Claims Commission."

There is more detail given in the description but every sentence stresses that this database provides names and details of Loyalists, those who fled the Colonies during and after the Revolutionary War 1775-1783. However this is incorrect! Badly incorrect.

The records are divided into Series I (AO12) and Series II (AO13).

Yes there are some Loyalist claims and documents in this set of records. But a very quick look in Series II (AO 13) reveals that in the section titled "American-Loyalist Claims Series II (140) Miscellaneous 1801-1835", we find Claims for Losses in Upper Canada after the War of 1812.

These claims for losses were not filed by Loyalists but by ordinary citizens who suffered at the hands of the Americans or the Indians during that War. This specific (and valuable!) list of those filing claims is dated May 1824 and begins on image 15 of 228. It ends on image 49 at claimant number 2054.

It's an invaluable database but sadly not many researchers will find it since it is not listed correctly on Ancestry.com. And for those who do stumble on it by searching and finding an ancestor's name, they are almost certain to think that finding that name in this database means that their ancestor was a Loyalist.

Please don't be fooled. When searching a large database, be sure to scroll back to the start of the specific section your ancestor's name is on. Look for the title of that specific set of records so that you know what you have found and can provide an accurate and correct source for the information.

Index of Claimants Found in Commissioners Reports 1836-1845 Ontario

A complete and correct list of contents of many of the films can be found on Olive Tree Genealogy website at Finding Aid for Heir & Devisee Commission Online Films

As I continue in my corrections, I happened upon this wonderful index of names for Commissioners Reports 1836-1845 on film H1151. The Canadiana.org description stating that H1151 contains V. 90-98 is incorrect. This film contains V. 86-89 Below is the index for Names A-C for Volume 86 of microfilm H1151 Heir & Devisee Commission. You may save these images to your computer then enlarge them in your graphic program to read. There are 32 pages of names total and I will continue publishing them here on Olive Tree Genealogy blog.

Volume 86 consists of Commissioners Reports 1836-1845 on images 49-319. Using the index below, you see that Robert Brown is indexed as page 168. We can then go directly to the Heir & Devisee Commission online microfilm and hunt for this page in order to view Robert's claim.
